The Federal Communications Commission (FCC) makes it generally illegal to deliver a prerecorded message to a consumer or business phone (cell & landline) or use an ‘automatic telephone dialing system’ to call any cell phone unless you obtain prior written consent. Individuals who add themselves to the national Do-Not-Call (DNC) list are protected from prerecorded or auto-dialed calls.
When connecting with new leads, our system is intentionally incapable of making illegal auto-dialed or prerecorded calls. Leverly only auto dials your company and sales team, who then manually ‘press 1’ to connect with leads. The manual dialing process requires human intervention, which is compliant and immediate in the way we connect you with leads (on cell or landlines) without the use of restricted technology.
In short, the Leverly service is compliant with new regulations. You do not need to ask for any additional consent in order to use the Leverly service.
Why We Don’t Use Automated Calls to Leads
The primary reason is because it is not as effective. People hang up more often on automated calls and perceive them as Spam.
This method is also riddled with risks. When communicating with new leads, aged leads, or current customers, the FCC makes it illegal to deliver a prerecorded message or use any form of automated dialing to call a cell phone unless you obtain prior written consent.
It is still compliant to send prerecorded messages to business landlines without consent. Therefore, when using automation to reach out to prospects in your old database (without consent), your database needs to be scrubbed against a list of all cell phone numbers which can get complicated since many business use cell phones as their business phones.
